Key Stages
Once you have instructed Wills & Probate Solutions Ltd to prepare (a) new Will(s), we will send you our client care letter. This letter gives you the information about who you will be dealing with and our fixed fee. Also included is the Will Information questionnaire for you to complete. Once this has been returned to us, drafts will be prepared an sent to you within one week of receipt, together with our letter outlining the clauses in your Will(s).
It is then up to you to come back to us with questions, errors or omissions; amended drafts will be sent to you within one week. This process will continue until you have confirmed that the draft(s) is/are correct. We will then prepare the engrossments for signing and either arrange a time to meet with you to sign them, or post them to you, with clear instructions as to how they should be signed to ensure their validity.
Service Information
Simple, single Will:
One person (Testator/Testatrix) appointing up to 4 Executors / Executrices, dealing with any specific gifts and distributing the Residuary Estate;
Simple Mirror Wills:
A couple, appointing up to 4 Executors / Executrices, making specific gifts; everything to the surviving spouse on the first death, then equally between children / grandchildren / great-grandchildren etc with final substitute gift.
Life Interest Wills
There are two ways of owning a beneficial interest in a property:-
- Joint Tenants
This is where two people own all of a property together and it passes to the survivor automatically on the first death;
- Tenants in Common
This is where the Joint Tenancy has been severed and the beneficial ownership is split (usually as 50% each). In this situation, the share of the property needs to be dealt with in the Will as it does not pass to the surviving owner.
Life Interest Wills include additional clauses in each Will to deal with the necessary rights and requirements for the surviving owner during their lifetime, together with who is to receive the individual shares which are gifted through the Will.
